Privacy Policy

The privacy of visitors to our website is very important to us, and we are committed to protecting it. This privacy and cookies policy (hereinafter, the "Policy") explains what we will do with your personal information.

This Policy applies only to information collected on our website; we are not responsible for the privacy policies or content of third-party websites.

1. TERMS AND DEFINITIONS

1.1. "Website" (hereinafter, the "Site") means an information resource on the Internet that contains text, graphics, and other information perceived as a whole and is supported by a set of system software tools.

1.2. "Site Owner" (hereinafter, the "Owner") is the controller and processor of the personal data of the Site's Users.

1.3. "User" means any natural person who has at any time accessed the Site and has reached the age permitted to accept the user agreement posted on the Site and this Policy.

1.4. "Account" means the User's account created when signing in on the Site, which allows the Owner to identify (authenticate) the User by using the User's account on social networks Facebook, Twitter, or Google.

1.5. "Personal data" means information or a set of information about a User who is identified or can be specifically identified.

1.6. "Services" (Site services) means any services offered on the Owner's Site, including but not limited to services for creating platforms for communication with businesses and new formats of materials and special projects, creating and improving content quality for Users, video production, industry special projects, direct advertising, etc.

2. COLLECTION AND USE OF PERSONAL DATA

2.1. Use of the Site does not require registration and/or authentication or direct provision of personal data that can identify you, except as provided in clause 2.2 of the Policy.

2.2. At your discretion, for greater convenience when using the Site, you may sign in on the Site using your personal account on social networks Facebook, Twitter, or Google.

2.3. When you use the Site, we may automatically collect information related to your use of the Site.

2.4. We may collect, store, and use the following types of your personal data:

  • 2.4.1. information about your computer, including IP address, geographic location, browser type and version, and operating system;
  • 2.4.2. information about your visits to and use of this Site, including referral source, visit duration, pages viewed, and navigation paths on the Site;
  • 2.4.3. information you provide when authenticating an account on our Site as set out in clause 2.2 of this Policy, for example your name, photos from the social network used to sign in, gender, date of birth, relationship status, interests and hobbies, education and employment details, email address, and contact information;
  • 2.4.4. information such as your name and email address that you enter to subscribe to our emails and/or newsletters;
  • 2.4.5. information you enter when using services on our Site;
  • 2.4.6. information generated while using our Site, including when, how often, and under what circumstances you use it;
  • 2.4.7. information relating to services ordered on the Site or transactions you carry out through our Site, including your name, address, phone number, email address, and credit card details;
  • 2.4.8. information you post on our Site for publication on the Internet, including your username, profile picture, and the content of your posts;
  • 2.4.9. information contained in any messages you send to us by email or through our Site, including their content and metadata;
  • 2.4.10. any other personal information you send to us.

2.5. Before disclosing another person's personal information to us, you must obtain that person's consent to both the disclosure and the processing of that personal information in accordance with this Policy.

2.6. When you visit the Site, a connection is established, data on the Site is accessed, and a log file may be created. It may include: the date and time of access to the Site; the IP address from which the Site was accessed; the data or name of the file you accessed on the Site; the amount of time spent on the Site; the name and version of your web browser and operating system; the name of the website from which you navigated to the Site. This information is used to improve Site performance, for security reasons, to ensure stable operation of the Site, and to protect the Site from possible external attacks. We may also perform statistical analysis of this data. Data stored in the log file does not allow us to identify you personally. Log file data is used only for the purposes stated in this Policy and is not transferred to third parties except as provided in clause 7.2 of the Policy.

2.7. We collect only personal data that you knowingly and voluntarily provide as the data subject for the purpose of using the Site's services, which, under the requirements of applicable law of Ukraine, constitutes the data subject's consent to the processing of their personal data for the purposes of processing stated in this Policy.

2.8. We guarantee that we will not sell or rent Users' personal data to third parties, except where disclosure of your personal data is necessary to comply with applicable law of Ukraine.

2.9. We do not collect or process information about your personal data concerning racial or ethnic origin, political, religious, or philosophical beliefs, membership in political parties and trade unions, criminal convictions, or data concerning health, sex life, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine "On Personal Data Protection").

3. PROCESSING OF PERSONAL DATA

3.1. Processing and storage of the personal data provided takes place in data centres where the equipment that supports the Site's services is hosted. The personal data provided is processed and may be stored in a personal data database or a separate table of the Site's database.

4. PURPOSES OF USE OF PERSONAL DATA

4.1. We may use your personal information for the following purposes:

  • 4.1.1. administering our Site and business;
  • 4.1.2. personalising our Site for you;
  • 4.1.3. enabling you to use services available on our Site;
  • 4.1.4. sending you statements, invoices, and payment reminders and collecting payments from you;
  • 4.1.5. sending you non-marketing commercial communications;
  • 4.1.6. sending you email notifications if you have subscribed to email notifications;
  • 4.1.7. sending you our email newsletter if you have subscribed to it. You may also inform us at any time if you no longer wish to receive the newsletter;
  • 4.1.8. sending you email marketing communications relating to our business or the businesses of carefully selected third parties that we believe may interest you. You may also inform us at Empathceramics@gmail.com if you no longer wish to receive marketing communications;
  • 4.1.9. providing third parties with statistical information about our users (where those third parties will not be able to identify any individual user from that information);
  • 4.1.10. dealing with enquiries and complaints made by or about you relating to our Site;
  • 4.1.11. keeping our Site secure and preventing fraud;
  • 4.1.12. verifying compliance with the terms governing use of our Site (including monitoring private messages sent through our Site's private messaging service);
  • 4.1.13. and other uses.

4.2. If you submit personal information for publication on our Site, we will publish and otherwise use that information in accordance with the licence or consent you grant to us.

4.3. Your privacy settings may be used to limit the publication of your information on our Site and can be adjusted using privacy controls on the Site.

4.4. We will not, without your express consent, supply your personal information to any third party for their direct marketing or for any other purposes, except as provided by applicable law of Ukraine.

5. RETENTION PERIOD FOR PERSONAL DATA

5.1. Personal data is stored for no longer than necessary for the purposes of processing.

5.2. After you cease to be a User of the Site by deleting your Account on the Site, your personal data is also automatically deleted.

6. INTERACTION OF THE SITE WITH OTHER RESOURCES

6.1. When you use services on the Site, pages may contain code from other Internet resources and third parties, as a result of which such resources and third parties may receive your data. These Internet resources may receive and process information that you visited these pages, as well as other information transmitted by your browser. Such resources may include: banner systems (e.g. DoubleClick for Publishers, Admixer, AdRiver, etc.); social network plugins (e.g. Disqus, Facebook, Twitter, Google+).

6.2. Use of these services is necessary for timely analysis of Site visits, internal and external assessment of Site traffic, depth of views, and User activity. We do not store or process data obtained from these services.

6.3. If, for any reason, you do not wish the services referred to in clause 6.1 of the Policy to have access to your personal data, you may, at your own discretion, sign out of your Account and clear cookies (through your browser).

7. OWNER'S INTERACTION WITH THIRD PARTIES REGARDING PERSONAL DATA

7.1. We do not transfer personal data to third parties except where such transfer is required by applicable law of Ukraine, at the request of the data subject, or in other cases set out in this Policy. We understand that personal information is valuable and an integral part, including of the personal non-property rights of any natural person, and therefore we take all reasonable measures to protect your personal information.

7.2. Your personal data may be accessed by our authorised employees who have agreed to maintain the confidentiality of Users' personal data, as well as third parties who provide us with Site support and administration services and other services related to the Owner's business activities. Our authorised employees and/or third parties, under agreements concluded with us, undertake to comply with all requirements of applicable law of Ukraine regarding the protection and confidentiality of Users' personal data.

7.3. The Site may contain links to other websites (for information only). When you follow a link to other websites, this Policy does not apply to those sites. We therefore recommend that you review the privacy and personal data policy of each website before transmitting any personal data by which you can be identified.

7.4. Personal information you publish on our Site may be available via the Internet worldwide. We cannot prevent the use or misuse of such information by third parties in other countries.

8. PROTECTION OF PERSONAL DATA

8.1. We use generally accepted technological and operational standards to protect information and personal data from loss, misuse, alteration, or destruction, but we do not guarantee absolute security against any threats arising outside our control.

8.2. We ensure compliance with all relevant confidentiality obligations and technical and organisational security measures to prevent unauthorised or unlawful disclosure or processing of such information and data, and their accidental loss, destruction, or damage.

8.3. We have the right to disclose personal data without your consent in cases defined by applicable law of Ukraine, and only (where necessary) in the interests of national security, economic well-being, and human rights.

8.4. If you have granted or lost access to your Account, you bear full and sole responsibility for the actions of a new User using the Site and/or the Site's Services from your Account.

9. CONDITIONS OF ACCESS TO PERSONAL DATA

9.1. The procedure for third-party access to personal data is determined by the consent given by the User to the Owner to process such data, or in accordance with legal requirements.

9.2. You have the right to obtain any information about yourself from any party involved in relations concerning personal data, subject to providing your surname, first name, patronymic, place of residence (stay), and details of the identity document of the person submitting the request, except as established by applicable law of Ukraine.

9.3. Access to data about yourself is provided free of charge. Deferral of access to your personal data is not permitted. Deferral of access to personal data by third parties is permitted if the required data cannot be provided within thirty calendar days from receipt of the request. In that case, the total period for resolving the issues raised in the request must not exceed forty-five calendar days.

9.4. Notice of deferral must be given in writing to the third party who submitted the request, with an explanation of the procedure for appealing that decision.

9.5. Refusal of access to personal data is permitted, in the manner established by applicable law of Ukraine, if access is prohibited under the Law of Ukraine "On Personal Data Protection".

9.6. A decision to defer or refuse access to personal data may be appealed to the Ukrainian Parliament Commissioner for Human Rights or a court.

10. YOUR RIGHTS AS A USER (DATA SUBJECT)

10.1. As a User (data subject), you have the right to:

  1. know the sources of collection and location of your personal data, the purpose of their processing, the location of the Owner or to give appropriate instructions to obtain this information from authorised persons, except as established by the Law of Ukraine "On Personal Data Protection";
  2. receive information on the terms of access to personal data, including information about third parties to whom your personal data is transferred;
  3. access your personal data;
  4. receive, no later than thirty calendar days from receipt of the request (except as provided by the Law of Ukraine "On Personal Data Protection"), a response as to whether your personal data is being processed, and obtain the content of such personal data;
  5. submit a reasoned objection to the Owner against the processing of your personal data;
  6. submit a reasoned request for the Owner to change or destroy your personal data if such data is processed unlawfully or is inaccurate;
  7. protection of your personal data against unlawful processing and accidental loss, destruction, or damage due to intentional concealment, failure to provide, or untimely provision, as well as protection against information that is inaccurate or harms your honour, dignity, and business reputation;
  8. file complaints regarding the processing of your personal data with the Ukrainian Parliament Commissioner for Human Rights or a court;
  9. use legal remedies in case of violation of applicable law of Ukraine on personal data protection;
  10. make reservations regarding the limitation of the right to process your personal data when giving consent;
  11. withdraw consent to the processing of personal data;
  12. know the mechanism of automated processing of personal data;
  13. protection against an automated decision that produces legal effects concerning you.

11. COOKIES

11.1. Our Site uses cookies. A cookie is a file containing an identifier (a string of letters and numbers) that the web server sends to the web browser, and the browser stores it. The identifier is then sent back to the server each time the browser requests a page from the server. Cookies may be either "persistent" cookies or "session" cookies: a persistent cookie is stored by the browser and remains valid until its set expiry date unless you delete it before then; a session cookie expires at the end of your session when you close the browser. Cookies typically do not contain information that personally identifies you, but personal information we store about you may be linked to information stored in and obtained from cookies.

11.2. The names of the cookies we use on our Site and the purposes for which they are used are set out below: we use Google Analytics on our Site to recognise a computer when a User visits our Site. Most browsers allow you to refuse cookies—for example: in Internet Explorer (version 10) you can block cookies using the cookie handling override settings by clicking "Tools", "Internet Options", "Privacy", and then "Advanced"; in Firefox (version 24) you can block all cookies by clicking "Tools", "Options", "Privacy", selecting "Use custom settings for history" from the drop-down menu, and unticking "Accept cookies from sites"; and in Chrome (version 29) you can block all cookies by opening the "Customize and control" menu, clicking "Settings", "Show advanced settings", and "Content settings", then selecting "Block sites from setting any data" under "Cookies".

11.3. Blocking all cookies will negatively affect the usability of the Site. If you block cookies, you will not be able to use all features of our Site.

11.4. You can delete cookies already stored on your computer. Deleting cookies will negatively affect the usability of many websites. To delete cookies: in Internet Explorer (version 10) you must manually delete cookie files (instructions are available at support.microsoft.com/kb/278835); in Firefox (version 24) you can delete cookies by clicking "Tools", "Options", and "Privacy", then selecting "Use custom settings for history", clicking "Show Cookies", and then "Remove All Cookies"; and in Chrome (version 29) you can delete all cookies by opening the "Customize and control" menu and clicking "Settings", "Show advanced settings", and "Clear browsing data", then selecting "Cookies and other site and plugin data" before clicking "Clear browsing data".

12. CHANGES TO THE POLICY

12.1. We reserve the right to publish separate privacy notices and to change and/or supplement the content of the Policy at any time at our discretion.

12.2. If material changes are made to the Policy, we will post a notice on the Site and specify the date on which those changes take effect. If you do not object in writing to accepting those changes within the specified period, this will mean that you have agreed to the relevant changes to the Policy.
